  1.                         SmartDraw Software License Agreement

  3. Grant of License
  4. This SmartDraw license agreement grants you a non-exclusive right to load and use the SmartDraw 
  5. Software Shareware Version 1.0x (the "Software") for a period of 30 days from the date that the software 
  6. was first loaded on one or more computers. Once the 30 day period has expired, you (the licensee) agree to 
  7. either purchase a permanent license to use the software, or to destroy the Software and all copies in your 
  8. possesion.

  10. The software is "loaded" onto a computer when it is either copied to the permanent memory of the 
  11. computer (for example, the hard disk) or loaded into the temporary memory (RAM), such as when a 
  12. computer runs the software from a network server, or a floppy disk.

  14. Copyright
  15. The Software is owned by SmartDraw Software Inc. and is protected by United States copyright laws and 
  16. international treaty provisions. You must treat the software like any other copyrighted material ( for 
  17. example, a book), except that you may make a copy for the purposes of loading it onto the hard disk of the 
  18. computers that are licensed under this agreement.

  20. Other Restrictions
  21. You may not transfer your rights under this agreement. You must not rent or lease this software. You may 
  22. not decompile or disassemble the Software. You may not distribute the Software as part of any of
  23. any other software, or collection of software without the agreement of SmartDraw
  24. Software Inc.

  26. Distribution
  27. The shareware version of SmartDraw may distributed only under the terms and conditions of the
  28. Distribution License (shown below).

  31. LIMITED WARRANTY AND DISCLAIMER OF WARRANTY

  33. THIS SOFTWARE AND ACCOMPANYING WRITTEN MATERIALS (INCLUDING INSTRUCTIONS 
  34. FOR USE) ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. FURTHER, 
  35. SMARTDRAW SOFTWARE INC. DOES NOT WARRANT, GUARANTEE, OR MAKE ANY 
  36. REPRESENTATIONS REGARDING THE USE, OR THE RESULTS OF USE, OF THE SOFTWARE 
  37. OR WRITTEN MATERIALS IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, 
  38. CURRENTNESS, OR OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND 
  39. PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU. 
  40. IF THE SOFTWARE OR WRITTEN MATERIALS ARE DEFECTIVE YOU, AND NOT 
  41. SMARTDRAW SOFTWARE INC. OR ITS DEALERS, DISTRIBUTORS, AGENTS, OR EMPLOYEES, 
  42. ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.

  44. THE ABOVE IS THE ONLY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, 
  45. INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND
  46. FITNESS FOR A PARTICULAR PURPOSE, THAT IS MADE BY SMARTDRAW SOFTWARE INC., 
  47. ON THIS SMARTDRAW SOFTWARE INC. PRODUCT. NO ORAL OR WRITTEN INFORMATION 
  48. OR ADVICE GIVEN BY SMARTDRAW SOFTWARE INC., ITS DEALERS,DISTRIBUTORS, 
  49. AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE 
  50. SCOPE OF THIS WARRANTY AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR 
  51. ADVICE. YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

  53. NEITHER SMARTDRAW SOFTWARE INC. NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN 
  54. THE CREATION, PRODUCTION OR DELIVERY OF THIS PRODUCT SHALL BE LIABLE FOR 
  55. ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING 
  56. DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS 
  57. INFORMATION, ANDTHE LIKE) ARISING OUT OF THE USE OR INABILITY TO USE SUCH 
  58. PRODUCT EVEN IF SMARTDRAW SOFTWARE INC. HAS BEEN ADVISED OF THE POSSIBILITY 
  59. OF SUCH DAMAGES.

  64.                       SMARTDRAW SHAREWARE VERSION DISTRIBUTOR LICENSE
  65. A license to distribute copies of  SmartDraw Shareware Version ("The Software") is granted 
  66. by SmartDraw Software Inc. subject to the following terms and conditions:

  68. 1. The Software remains the sole, exclusive, proprietary and confidential property of 
  69.    SmartDraw Software Inc.
  70.  
  71. 2. Copies of The Software distributed must include all files listed under 
  72.    FILES TO BE DISTRIBUTED below.
  73.  
  74. 3. Copies of The Software distributed must be identified as Shareware, 
  75.    and must be accompanied by a suitable definition of Shareware.
  76.  
  77. 4. The Software may not be modified in any way.
  78.  
  79. 5. This license may be terminated by SmartDraw Software Inc. at any time. 
  80.    For copies of the Software distributed by BBS's or on disks with no other programs, 
  81.    distribution of the Software will be stopped immediately following such a termination. 
  82.    For copies distributed as part of a collection of shareware, no new masters of a collection 
  83.    will be made that contain The Software immediately following such a termination.

  85. 6. The Software must clearly state the words "Licensed for use for 30 days only" in the
  86.    "About" dialog. [All shareware versions show this statement].
